Welcome to kitapbali.com (KITAP Bali), a service operated by PT Juara Holding. These Terms of Service (“Terms”) govern your access to and use of our website, services, and any information, content, or materials provided by us (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms, which constitute a legally binding agreement between you and KITAP Bali. Please read them carefully before proceeding.

2. Acceptance of Terms

By using our Services, you signify your unequivocal acceptance of these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately. Your continued use of the Services following the posting of any changes to these Terms will mean you accept those changes.

3. Scope of Services

KITAP Bali provides professional consulting and facilitation services for Indonesian visa and immigration applications. Our Services include, but are not limited to, providing expert advice, assisting with document preparation, reviewing application forms, offering guidance on application procedures, and facilitating the submission of applications to the relevant Indonesian government authorities. We strive to offer accurate and up-to-date information based on current regulations.

Important Disclaimer: KITAP Bali acts solely as a consultant and facilitator. We do not issue visas, nor do we have any authority to influence or guarantee the approval of any visa or immigration application. The final decision on all applications rests solely with the Indonesian government, its immigration department, and other relevant agencies. We cannot be held responsible for any delays, rejections, or changes in government policy that may affect your application outcome. Our fees are for the services rendered in assisting you with the application process, not for the outcome of the application.

4. Client Responsibilities

As a client of KITAP Bali, you are solely responsible for providing complete, accurate, and truthful information and documentation required for your application. Any false, misleading, or incomplete information provided by you may result in the rejection of your application, forfeiture of fees, and potential legal consequences by Indonesian authorities. You are also responsible for responding promptly to requests for information or documentation from KITAP Bali or government agencies. Failure to do so may cause delays or rejection of your application.

5. Fees and Payment

The fees for KITAP Bali’s consulting and facilitation services will be clearly communicated to you, either on our website, through a direct quotation, or in a separate service agreement. All fees are quoted in Indonesian Rupiah (IDR) or as otherwise specified. Payment terms, including deposit requirements and installment schedules, will be outlined prior to the commencement of services. Please note that our service fees cover the professional assistance provided by KITAP Bali and do not include any government application fees, visa fees, levies, third-party costs (e.g., translation, notarization, medical checks), or courier charges, which are your sole responsibility and must be paid separately.

6. Refund Policy

Our comprehensive refund policy is detailed in a separate document available on our website. We encourage you to review it thoroughly before engaging our Services. Generally, fees paid for services rendered by KITAP Bali are non-refundable, especially once work on your application has commenced, documents have been processed, or advice has been provided. Refunds, if applicable, will be processed according to the specific terms outlined in our Refund Policy, taking into account the extent of services already provided and any administrative costs incurred.

7. Intellectual Property

All content on the KITAP Bali website, including text, graphics, logos, images, and software, is the property of PT Juara Holding or its content suppliers and is protected by Indonesian and international copyright laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without the prior written consent of KITAP Bali.

8. Limitation of Liability

To the fullest extent permitted by applicable law, KITAP Bali, its directors, employees, affiliates, agents, or licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall KITAP Bali’s total liability to you for all damages, losses, and causes of action exceed the total amount paid by you to KITAP Bali for the specific services giving rise to the claim. We disclaim all liability for any errors, omissions, or inaccuracies in the information provided due to changes in government regulations, policies, or interpretations thereof, or for any action or inaction taken by government authorities. We are not liable for any losses or damages arising from delays, rejections, or cancellations of visas or applications by government bodies.

9. Indemnification

You agree to defend, indemnify, and hold harmless KITAP Bali, its affiliates, licensors, and service providers, and its respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any use of the website’s content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the website.

10. Force Majeure

KITAP Bali shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials. In such events, KITAP Bali’s obligations will be suspended for the duration of the Force Majeure event, and we will make reasonable efforts to mitigate the impact and resume performance as soon as practicable.

11. Governing Law and Dispute Resolution

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, shall be exclusively settled by the competent courts of Indonesia. You agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims or disputes.

12. Modifications to Terms

KITAP Bali reserves the right, at its sole discretion, to modify or replace
